Substitute teacher sentenced

A substitute teacher has acknowledged that he sent sexually explicit photos to students.

20-year-old Tyler Myers pleaded guilty today to three misdemeanor counts of disseminating harmful material to minors. The Ethan resident received a 60-day suspended jail sentence for each count and was ordered to pay more than $800 in fines.

Myers was charged earlier this year after Ethan High School officials contacted law enforcement. Authorities accused Myers of sending explicit images of himself to three 17-year-old students.

Myers had worked at the high school as a substitute physical education teacher and substitute janitor.

Judge Gordon Swanson determined it was unnecessary to require Myers to attend counseling. Swanson also questioned the Ethan School District's decision to make a "20-year-old kid" responsible for high school students.

Area Army National Guard units prepare for deployment

More than 160 Soldiers from the South Dakota Army National Guard's 153rd Engineer Battalion and its Forward Support Company have received an official mobilization order for a nine month deployment to Kuwait beginning in November 2016.

The mission of the Huron-based 153rd Eng. Bn. is to provide command and control for assigned or attached engineer units. The mission of the Huron- and Parkston-based FSC is to provide logistics and maintenance support. The unit will report to Fort Bliss, Texas, to complete several weeks of theater-specific training prior to deployment overseas.

This will be the second mobilization for the 153rd Eng. Bn., which deployed to Iraq in support of Operation Iraqi Freedom in 2004-2005. This is the first deployment for the FSC.

Charges filed in fatal crash

Authorities have filed several charges regarding to Saturday morning’s fatal crash south of Mitchell.

Davison County States Attorney Jim Miskimins says eighteen year old Tate Thompson of Ethan is charged with driving under the influence, vehicular battery, vehicular homicide and hit and run resulting in serious injury or death. Thompson is free on bond. His next court appearance is July 28th in Mitchell.

The South Dakota Highway Patrol says Thompson failed to negotiate a curve on a gravel road when the vehicle went into the south ditch around 4 am Saturday.

Eighteen year old Dylan Mentele died at the scene. A seventeen year old Mitchell girl was seriously injured. Thompson, and two other eighteen year old passengers, William Lanstraat of Stickney and Justin Roster of Alexandria, sustained minor injuries.

Authorities identify 18 year old killed in Saturday morning crash

An 18 year old man from Alexandria has been identified as the person killed in a one-vehicle crash that occurred early Saturday morning south of Mitchell. Four others were injured. Dylan Mentele was a passenger. He was ejected from the vehicle and died at the scene.

A 2011 GMC Sierra was eastbound when the driver, 18 year old Tate Thompson of Ethan failed to negotiate a curve east of the intersection of 258th Street and 409th Avenue. The vehicle went into the south ditch.

 A 17 year old female passenger from Mitchell sustained life-threatening injuries and was airlifted to a Sioux Falls hospital. Thompson, the driver, and 18 year olds William Langstraat of Stickney and Justin Roster of Alexandria sustained minor Injuries.

Charges are pending against Thompson. It is unknown if any of the occupants were wearing seatbelts.

 South Dakota’s Highway Patrol is investigating the crash. Other agencies on scene were the Davison County Sheriff’s Office, Mitchell EMS, Davison County Search and Rescue and the state Division of Criminal Investigation.

One person was killed and four others injured in a one-vehicle crash that occurred early Saturday morning south of Mitchell

The names of those involved are not being released pending notification of family members.

Suspect sought in Salem Drug burglary

McCook County authorities are asking for your help in finding who’s responsible for a burglary in Salem Wednesday night.

The Attorney General’s office and McCook County Sheriff’s Office confirm that someone broke into Salem Drug around 11:17 pm.

Surveillance video depicts a male suspect.

Two teenage girls face burglary and drug charges

On 06-20-2016 the two 16 year olds, entered a residence located on the 400 block of E. 3rd Avenue in Mitchell through an unlocked window and stole items including an AR-15 semi-automatic assault rifle, a Glock 9 mm handgun, a lap top computer, a purse, and an x-box video game.  The burglary was discovered when the home owner returned to the residence at 5:24 p.m. and saw the suspects running away from the residence with the rifle and other items. The home owner, notified The Mitchell Police Division.   The suspects were later taken into custody without incident near the softball field at Hitchcock Park at approx. 9:15 p.m.   One of suspects hid the handgun at the park shortly before their arrest.  A small amount of marijuana and drug paraphernalia were found in the suspects’ possession at the time of their arrest.  The firearms and many of the stolen items have been recovered by law enforcement.  This is an ongoing investigation.

 Second Degree Burglary is a class 3 felony punishable by 15 years imprisonment in the state penitentiary and a fine of $30,000.  Grand Theft of a Firearm valued less than $2,500 is a class 6 felony punishable by 2 years imprisonment in the state penitentiary and a fine of $4,000.  Possession of a pistol by a minor is a class 1 misdemeanor punishable by one year imprisonment in a county jail and/or a $2,000 fine.  Possession of Drug Paraphernalia is a class 1 misdemeanor punishable by 30 days imprisonment in a county jail and/or a $500 fine.

 

The South Dakota Division of Criminal Investigation, and The South Dakota Department of Corrections assisted with the Investigation.

Police seek stolen pickup

A vehicle that had been reported stolen in Pierre has been seen in the Queen of Peace area in Mitchell. The vehicle is a red Ford F-250 Super Duty, 4 door pickup, with Oleson Plumbing markings on it. South Dakota Commercial License 06137A. At the time the vehicle was occupied by at least one woman. 

The vehicle and occupant are also the suspects in vehicle burglaries in the area.

Main Street businesses face flooding

MITCHELL, S.D. (AP) — A water main break flooded at least three Main Street businesses in Mitchell.
The flooding Monday night ruined merchandise and forced businesses to close early.


Harve's Sport Shop owner Jim Johnston estimates that more than 1,000 gallons of water flooded his store. He says it was "kind of disheartening."
The water also affected the VFW and Mitchell's Float Spa.

Convicted sex offender arrested

Mitchell Police have arrested a 43 year old convicted sex offender for First degree rape and attempted sexual contact with a child under the age of 16. Lieutenant Don Everson says Chad Voeltz apparently engaged in sexual penetration with the child and also attempted to give the child money in exchange for sexually touching the victim. He says the incidents took place from 2009 to 2010 at Voeltz’s Mitchell residence and involved an 8 to 9 year-old child who was visiting the home at the time.

Voeltz was previously convicted of possessing, manufacturing or distributing child pornography in 2011.

First degree rape is punishable by up to life in prison and a fine up to $50,000.    Sexual contact with a child under 16 is punishable by up to15 years in prison a fine of up to $30,000.
