Two Mitchell women are facing felony drug charges

On Friday June 23, 2017, at approx. 1700 hrs., Officers with Mitchell Police Division executed a search warrant at a residence located at 917 E. 3rd Avenue #2 in Mitchell after an Officer performed a traffic stop on a vehicle that drove away from that residence. The vehicle was stopped in the 300 block of N. Kimball St. for a lane driving violation.  The driver of the vehicle, 29-year-old Melissa Kay Larvie, date of birth 02-14-1988, smelled like marijuana at the time of the stop.  Larvie’s vehicle had an altered vehicle seller’s permit attached to the vehicle. 

 An Officer searched Larvie’s vehicle and found approximately .85 gram of a substance that field-tested positive for cocaine and methamphetamine, zig zag rolling paper and marijuana residue and open alcoholic beverage containers.  Larvie was arrested for the following offenses:

-Possession of Less Than 2 ounces of Marijuana in violation of S.D.C.L. 22-42-6

-2 Counts of Unauthorized Possession of a Controlled Substance in violation of S.D.C.L. 22-42-5

-Possession of Drug Paraphernalia in violation of S.D.C.L. 22-42A-3

-Substitution of License Plates in violation of S.D.C.L. 32-5-103

-No Valid Driver’s License in violation of S.D.C.L. 32-12-22 -Open Alcoholic Beverage in a motor vehicle in violation of S.D.C.L.  35-1-9.1

-A Davison County arrest warrant for Failure to Appear

One resident of 917 E. 3rd Ave. #2, 26-year-old Audra Rae Turner, date of birth 11-21-1990, was also arrested for the offense of Unauthorized Possession of a Controlled Substance.  Turner was inside the residence when the search warrant was executed. A baggie with residue that field tested positive for methamphetamine was found in Turner’s bedroom. 

Possession of Less Than 2 ounces of marijuana is a Class 1 Misdemeanor punishable by  up to one year  imprisonment in a county jail  and/or a fine of $2,000.  Unauthorized Possession of a Controlled Substance is a Class  5   Felony punishable by 5  years imprisonment in the state penitentiary and or a fine of $10,000  on each count.     Substitution of License Plates, No Valid Driver’s License, Open Alcoholic Beverage Container in a Motor Vehicle and  Possession of Drug Paraphernalia are Class 2 misdemeanors  punishable by 30 days imprisonment in a county jail and/or a $500 fine.

The Mitchell Police Division Emergency Response Team was used to execute this search warrant at 917 E. 3rd Ave. #2.  This team was  used, as it was believed that there was one suspect with a lengthy criminal record who had a firearm in his possession at this residence. The suspect was not found at the residence.

The Davison Co. Sheriff’s Office and The Sanborn County Sheriff’s Office assisted with this investigation.

Other criminal charges are pending.  This is an ongoing investigation.
